Attorney General Eric Schneiderman announced a settlement with Casella Waste Systems resolving concerns that Casella’s restrictive contracting practices, market dominance and pattern of acquisitions of smaller competitors, unlawfully restrained competition in the Southern Tier. The settlement requires Casella to change its contracts to reduce the legal and financial obstacles faced by customers that wish to switch to competing providers, they, agreed not to enroll customers in contracts with an initial term of more than 2 years & they agreed to make a monetary payment to New York State in the amount of $100,000.

Governor Cuomo announced that the new Cigarette Strike Force targeting illegal tobacco trafficking and sales has already seized nearly $1.7 million in cash and contraband that includes 2.7 million cigarettes and cigars in its first 6 months.  Cigarette and tobacco-related seizures by the Strike Force within the State Department of Taxation and Finance’s Criminal Investigations Division, have yielded $1.68 million in contraband and cash, including:  12,236 cartons of untaxed cigarettes, 254,873 cigars, 2,061 pounds of loose tobacco & 24,773 counterfeit cigarette tax stamps.

The Chenango county sheriff’s department arrested 23-year-old James Marshall of Guilford on a charge of 4th degree Grand Larceny.  Deputies charged Marshall following an investigation of stolen ATM card; he is accused of using the card & taking over $1,000 from the victim.  Marshall was processed and released on an appearance ticket for a later date in the Town of Guilford court.

The Chenango County Sheriff’s Office arrested 42-year-old Jennifer Woloszyn of Port Crane for Driving While intoxicated.  Woloszyn is accused of traveling at a speed in excess of 55 Miles an hour in the Town of Oxford, the investigation revealed her vehicle was not insured  & she was operating the vehicle while intoxicated.  She was issued Tickets and will appear in the Oxford Town Court at a later date.

New York state is in a stronger financial position, reflecting better budgeting and financial practices and an improved economy, according to a report on the 2014-15 state Financial Plan by State Comptroller Tom DiNapoli.   DiNapoli estimates that projected out-year gaps for the fiscal years ending in 2016 through 2018 average $2.5 billion annually, or 3.7 percent of average projected General Fund revenues, much lower than the levels of five and ten years ago. New York state ended fiscal year 2013-14 with General Fund reserves at $2.2 billion, the highest level since the end of 2008.  A copy of the report can be accessed at osc.state.ny.us.

P.M. NEWS MONDAY 7-14-14

The National Weather Service has confirmed that a tornado touched down near Reading, yesterday around 4:40 PM. The damages showed that this is an EF-1 tornado with wind speeds between 86 and 110 mph. Officials are continuing to investigate other sites across the state where other damage was reported.

State Police are teaming up with the Parks and Recreation Department for a new campaign, to ensure everyone is buckling up. More than 200 people killed in car accidents in New York last year were not wearing a seat belt. The agencies hope to reduce the number of fatalities by highlighting the importance of bucking up & the importance of using car seats for children. The National Highway Transportation Safety Administration said car crashes are the leading cause of death for children age 1 to 13.

Assemblyman Bill Magee has filed petitions to force a September Democratic primary against Michael Hennessy, the party’s pick in the 121st District. Democrats in Madison and Oneida counties dropped Magee and designated Hennessy, however, Magee won the endorsement of Otsego County Democrats. Magee has served 12 terms in office. This is his first primary challenge. Brookfield Town Supervisor John Salka filed petitions to run on the Republican and Conservative Party lines.

Governor Cuomo will seek legislation to let the state recoup millions in school tax breaks paid to high-income New Yorkers who did not qualify to receive them. The announcement came after an investigation found an estimated $28 million in school property-tax subsidies, since 2011, were granted to households ineligible to receive them because they earned more than $500,000 a year.

The Chenango County Sheriff’s department arrested 51-year-old William Smith & 46 year old Lisa Marie Labouf for 2nd degree Assault, Endangering the Welfare of a Child and 2nd degree Harassment. The 2 are accused of assaulting a female victim and harassing another female victim, in front of 2 children. Smith was arraigned in the Town of McDonough Court and remanded to the Chenango County Correctional Facility on $20,00 cash bail. Labouf was arraigned in the Town of Pharsalia Court and remanded to the Chenango County Correctional Facility in lieu of a $20,00 cash bail. Both are to reappear in the Town of German Court at a later date.

The Chenango county Sheriff’s department arrested 29-year-old Bradley Short of Otego for Unlawful Fleeing of a Police Officer and Reckless Endangerment. Short was charged after failing to stop for law enforcement for allegedly speeding. Short was arraigned in the Town of Plymouth Court and remanded to the Chenango County jail. Short was charged the following day with 1 count of Promoting prison contraband, where he is accused of possessing marihuana in the county jail, he was issued an appearance ticket for Town of Norwich court at a later date.

The national weather service investigators will be out again today looking to confirm more tornadic activity from yesterday’s storms.  One possible tornado appeared in Watkins glen, funnel clouds were reported in Binghamton, West Windsor, Windsor and Susquehanna County in Pennsylvania.

State Police arrested 19-year-old Damian Schlabsz of Unadilla for unlawful imprisonment & 2nd degree menacing, for allegedly attacking a woman with a knife near Bainbridge July 6th.  Schlabsz was taken to the Chenango County Jail in lieu of $50,000 bail.

Motorists are advised that the Prospect Street westbound lane will be closed at the Prospect Connector Road.  Crews will be performing excavation and embankment work the Prospect Connector Road between 7 a.m. and 5 p.m. today & tomorrow.  Flag personnel will guide alternating one-way traffic through the work zone. This work is expected to be completed by 5 p.m. on Tuesday, July 15, weather permitting.

P.M. NEWS FRIDAY 7-11-14

The Delaware County Sheriff’s Office arrested 36 year old Matthew Parker of Walton Thursday on a Sealed Grand Jury Indictment Warrant charging him with 3  counts of Criminal sale of a controlled substance.  Parker  was indicted by a Delaware County Grand Jury following a month long heroin trafficking investigation in Walton and Delhi.  Parker was found to be in possession of 293 bags of heroin, along with several hundred dollars cash, which was subsequently seized by Investigators.  Parker was also in possession of public assistance benefit cards from the State of New York as well as the State of Virginia.   Parker was arraigned in Delaware County Court before Honorable Judge Cark Becker on Thursday afternoon and was remanded to the Delaware County Correctional Facility without bail pending future court appearances.

State Police arrested Former Greene Police Chief Steven Dutcher of Greene on 3 counts of Grand larceny. 1 count of offering a false instrument for filing, falsifying business records, petty larceny & 2 counts for official misconduct.  Dutcher is accused of stealing 2 Greene Police Department patrol rifles, a vehicle dog cage, filing a false receipt with the Village of Greene for the purchase of 4 vehicle tires, attempting to conceal the theft of 4 vehicle tires, using the tires for personal use, & purchasing tires and a vacuum cleaner with Village funds for personal use.  Dutcher faces action on July 22nd.

State Police arrested 21 year old Jesse Emmett of West Davenport for Driving While Ability Impaired by Drugs, Criminal Possession of a Weapon & Aggravated Unlicensed Operation of a Motor Vehicle, and 29 year old Heidi Morgan of Knoxville, Tennessee for Criminal Possession of a Controlled Substance & Possession of a Hypodermic Instrument.  Emmett & Morgan were issued tickets returnable in the Town of Oneonta Court on July 22nd.

An Afton man was found with 221 bags of heroin after a recent traffic stop in Sanitaria Springs. 49-year-old John Tipler was seen by police driving on I 88 and then pulled over. Investigators received information that Tipler would be transporting narcotics, which were found in his vehicle and found to be packaged for sale. The Broome County Sheriff’s Office detectives along with a highway patrol unit conducted the arrest. Tipler was charged with a felony count of third-degree criminal possession of a controlled substance, arraigned in Fenton Town Court and sent to the Broome County jail without bail.

A retired Delaware County Sheriff’s sergeant was arrested after a domestic disturbance.  52-year-old Ted Tiska of Masonville was charged with 4th degree criminal mischief and 2nd degree harassment. Tiska is accused of breaking a windshield on a vehicle and pushing another person.  He was arraigned in Walton town court and released, pending an appearance in Masonville town court at a later date.

The House of Representatives passed legislation co-sponsored by area congressman Chris Gibson to prohibit the Federal Energy Regulatory Commission from implementing, administering, or enforcing their decision to create a new capacity zone.  The bill also seeks to secure specific language in the report that requires FERC to reexamine and reform the way that they conduct this type of decision-making to ensure that the Commissioner’s hear and consider the concerns of local ratepayers. The House is expected to pass the fiscal year 2015 Energy and Water Appropriations Bill later this evening.

Just 7% of roads in rural New York counties were in poor condition in 2012 while 14% of bridges were structurally deficient. New York’s rural bridges ranked 17th in the nation for their condition. The data is based on road and bridge ratings from various federal agencies, including the FHA and the NHTSA. In New York, 49% of roads in the rural counties were rated “mediocre” or “fair,” above the national rate of 40%.  The state is facing up to an $89 billion shortfall for infrastructure upgrades over the next 20 years, according to a report by state Comptroller Tom DiNapoli. That includes clean water and sewer and transportation upgrades.

Governor Cuomo believes the damage caused by storms in Madison County, where four people were killed, and in other Central New York communities will not qualify for federal disaster aid. The governor said if that happens, the state could step in instead. Four people were killed Tuesday night when a tornado hit the Goff Road area in the Madison County village of Smithfield. Other areas hit by Tuesday’s storm would also not qualify.

The 38th annual Unadilla Carnival Of Sales from the Unadilla Chamber of Commerce will be held tomorrow from 9:00 AM to 4:00 PM at the Unadilla Community House Field.  There will be village wide lawn sales, artists, crafters, vendors, antique sales, a bounce house and games for children, plus a chicken barbecue by the Unadilla Fire department.  Music will be performed by Mike Herman from 1:00 to 2:00 and the Roundhouse Rockers from 3:00 to 4:00 PM.

Congressman Chris Gibson announced the House of Representatives passed the Workforce Innovation and Opportunity Act, which reauthorizes the Workforce Investment Act and streamlines training services by eliminating 15 duplicative programs, reducing administrative costs for states, and improving transparency and accountability by creating new performance standards. It also reauthorizes the Adult Education and Family Literacy Act and the Rehabilitation Act of 1973 to improve employment outcomes and job skills among adults and people with disabilities. The bill passed by a vote of 415-6. The Senate 95-3 recently adopted an amended version of the bill.

Local counties will get more than $185 million in state and federal homeland security grants, to support infrastructure protection, sustain anti-terrorism programs, and enhance emergency preparedness and response. Otsego County will receive $500,000 for improvements and enhancements to merge 911 public safety-answering systems, and fund the implementation of new technologies for data sharing, greater operating efficiencies, and regional consolidation. Otsego, Delaware, Chenango and Broome counties, will share in $108,000 in a Hazardous Materials Grant program.

U.S. Senators Charles Schumer, and Kirsten Gillibrand will introduce the Protect Women’s Health from Corporate Interference Act, to restore the contraceptive coverage requirement guaranteed by the Affordable Care Act, and protect coverage of other health services from employers who want to impose their beliefs on their employees by denying benefits. The legislation would ensure no boss can use their personal belief, to limit what health care services an employee has access to.

If Congress doesn’t replenish the Highway Trust Fund by the end of the month, roadway and bridge projects in New York stand to lose millions in reimbursements. U.S. Senator Charles Schumer said the state needs up to $11 billion to keep various projects on schedule, if the Fund remains in limbo, without new funding from Congress, there would be a moratorium on new state highway projects and the jobs that come along with them. Schumer is urging his colleagues to support continuing the Highway Trust Fund for state projects

State Senator Jim Seward has filed nearly 4,000 signatures on nominating petitions for re-election as state senator representing the 51st senatorial district. Seward filed 3,099 signatures for the Republican Party nomination, 605 for the Independence party nod and 171 for the Conservative party designation. Seward was first elected to the state senate in 1986. So far, no democrats have announced their intention to unseat Seward in the general election.

The state DEC has proposed new black bear management measures, as bear incidents are becoming more frequent. The bear population has increased in certain regions to a point where bears are becoming a neighborhood issue. The black bear population has risen by 40 percent in the Southern Tier and Catskill areas between 2003 and 2009. The DEC’s Black Bear Management Plan proposes several changes to the current plan to maintain or reduce population levels in certain areas and reduce bear-human conflicts. Options include a longer bear hunting season, and consideration of the use of new bear trapping and baiting techniques

A group of restaurant servers, bartenders and delivery drivers is asking New York State to raise the $5 minimum wage for tipped workers to the full minimum wage of $8. The coalition is calling on Gov. Cuomo, and a state board that oversees wages, to increase the amount the business owners pay their tipped workers. Restaurant workers and other tip workers aren’t subject to the minimum wage because their income includes gratuities. The state’s minimum wage will rise to $9 by the end of 2015

The annual Gus Macker 3 on 3-basketball tournament will be held on east Main Street in Norwich this coming weekend.  Macker organizer Tom Revoir said that it is very important to participants to register Friday:

About 400 teams have signed up to participate in this year’s tournament, which usually draws up to 10,000 people to Norwich each year.

State Troopers at Oneonta arrested 38-year-old Kelle Diaz of Schenevus for Driving While Intoxicated with a BAC result of .23%. The arrest followed a traffic stop on State Route 7 in the Town of Maryland; Diaz was issued tickets returnable in the Town of Maryland Court on July 15th.

Delaware County Sheriff’s Investigators arrested 52-year-old Frederick Ranger of Davenport for failing to register his Internet and social media accounts as a level 3-sex offender.  Ranger is accused failing to register with authorities a Facebook account, an email address and mobile Internet access; he was issued an appearance ticket for Town of Delhi Court on July 29th.

Delhi police arrested 25-year-old Corey Pitt of Delhi on charges of 3rd degree burglary, criminal mischief, petty larceny, & criminal possession of stolen property.  Pitt was arraigned at the Delhi Town Court and was sent to the Delaware County Jail in lieu of $10,000 cash bail pending future court action.

The Otsego County Sheriff’s Deputies arrested 29-year-old Meghan Matthews of Oneonta on 2 counts of 4th degree criminal sale of a controlled substance, for allegedly selling narcotics on separate occasions earlier this year.  Matthews was arraigned & was sent to the Otsego County Jail without bail, pending court action on July 18th.

Governor Cuomo announced $900,000 in funding for projects supported by the State University of New York Health Network of Excellence. This first round of funding will be awarded to 6 projects on 9 SUNY campuses, in this round, Binghamton University will be helping to develop a new 3D printing technology for custom manufacturing of soft tissues used in organ transplantation; along with the University at Albany, Cornell University & Rensselaer Polytechnic Institute.

Oneonta school district voters approved 2 propositions Tuesday.  Voters approved by a vote of 120 to 24, to authorize the district to establish a Buildings and Capital Reserve Fund, they also approved a bond for renovations to the High School swimming pool by a vote of 109 to 37.

The State Legislature has voted to require health insurers provide coverage for equipment and supplies for treating ostomies, intended to help ease the financial burden for people with the chronic condition. An ostomy is a surgically created opening in the body for the discharge of waste. If signed by Gov. Cuomo, the amendment to state insurance law would make coverage subject to annual deductibles and co-insurance as the Department of Financial Services deems appropriate.
