A jury was seated in a federal courtroom in White Plains Monday in the trial of State Senator Tom Libous of Binghamton. Libous is accused of lying to the FBI about using his political influence in getting his son Matthew at a Westchester law firm. Matthew Libous faces prison time for tax evasion. Tom Libous still holds a seat in the New York State Senate.

Federal officials have scheduled hearings on the 2nd natural gas pipeline proposal through the Southern Tier. The sessions hosted by the Federal Energy Regulatory Commission will begin at 7:00 PM Thursday at the Foothills Performing Arts Center in Oneonta, & at the Days Inn in Schoharie. Kinder Morgan proposes constructing a pipeline along the same corridor as the recently approved Constitution Pipeline, to move gas from Pennsylvania into New England. The Kinder Morgan Pipeline still needs approval from FERC.

State Police at Oneonta arrested 46 year old Nicholas Mihalik of Davenport for 3rd degree Assault. The arrest resulted from a complaint at a residence in the Town of Kortright, Mihalik was arraigned and remanded to the Delaware County Jail on bail.

Delaware County Public Health will hold a Free Rabies Vaccination Clinic For dogs, cats, and ferrets today. The clinic will run from 5:00 to 6:30 PM in the Colchester Highway Garage in Downsville.

P.M. NEWS MONDAY 7-13-15

State Police responded to a report of a 1-car fatal rollover motor vehicle accident on State Route 17. 36 year old Fareeha Nausheen of Monticello was operating a Honda minivan in a construction zone, when she lost control of the vehicle, it skidded across the open westbound lane of traffic and continued into the lane of traffic under construction, causing the vehicle to roll over several times. 77 year old Muktar Began of Monticello was ejected and was struck by the vehicle prior to it coming to rest in the center median, Began was pronounced deceased at the scene. A 3-year-old rear seat passenger was also ejected from the vehicle and sustained a minor injury. 4 surviving passengers were transported to Wilson Hospital in Johnson City to be treated for non-life threatening injuries. Nausheen was ticketed for moving from lane unsafely and failure to use child restraint seats for rear seat passengers & faces court action in the Town of Windsor Court on August 11th.

The Oneonta Police Department responded to a report of a robbery at the Smokers Choice Sunday at 76 Chestnut Street in Oneonta. The investigation revealed that the clerk on duty at the time, with another person, had conspired to steal money from the Smokers Choice and intended to report the theft as a robbery. Police arrested 20-year-old Morgan Reichart of Oneonta, for 5th degree Grand Larceny, 5th degree Conspiracy, Making a Punishable False Written Statement and Falsely Reporting an Incident. 26-year-old Mark Briley of Oneonta was charged with 5th degree Grand Larceny, & 5th degree Conspiracy, both were being held until arraignment in Oneonta court.

State Senate Republicans have secured a legally binding memorandum of understanding with the governor’s office amending provisions of the New York SAFE Act. The document suspends a portion of the SAFE Act establishing a statewide database requiring purchasers of ammunition to undergo a background check. The MOU also ends the moratorium on Internet sales of ammunition.

Governor Cuomo announced that more than $350,000 is available to help low-income families and veterans to participate in the FreshConnect Checks Program, which increases the purchasing power of food stamps used at participating farmers markets. More than 84,000 checks have already been issued to 152 sites across the state to help eligible New Yorkers access healthy foods, including fruits and vegetables. The program has also been extended to operate year-round at participating farmers’ markets, providing the opportunity to use checks 12 months a year. The Great New York State Fair is seeking singers to be the very first musical performers of each day. The contest is looking for New Yorkers to sing or play the National Anthem live twice in one day: once at 9:30 a.m. at Chevy Court to open the Fair, and again at 1 p.m. in the Toyota Coliseum to kick off afternoon equestrian competitions. Interested parties can upload videos to the contest site on the Fair’s Facebook page, or Email submissions to newyorkstatefair@agriculture.ny.gov. or drop off entries on DVD at the State Fair administrative office or mail them to the Fair at 581 State Fair Blvd., Syracuse NY, 13209. By a vote of 344-77, the House of Representatives adopted the 21st Century Cures Act, the legislation was authored by area Congressman Chris Gibson to combat Lyme disease and tick-borne illnesses, prioritizing federal research, setting benchmarks for progress on treatment and cures, acknowledging chronic Lyme, and giving patients and physicians who treat tick-borne illnesses a voice in the process. The National Institutes of Health will receive an additional $1.75 billion per year for the next five years and the FDA will receive an additional $550 million to help combat the illnesses.

State Police responded to a fatal motor vehicle collision involving a passenger car and a motorcycle on Route 11 in the Town of Marathon. 42 year old Christopher Tanner of Marathon crossed the center of the roadway, striking a motorcycle being operated by 49 year-old Shanon Nasoni of Endicott. Nasoni was airlifted to Upstate Medical Center in Syracuse, where she was pronounced deceased. Tanner had a BAC of .21, he was charged with Vehicular Manslaughter, Aggravated Driving While Intoxicated, and Failure to Keep Right. Tanner was arraigned in the Town of Marathon Court and was remanded to the Cortland County Jail without bail.

The trial of State Senator Tom Libous of Binghamton is scheduled to begin today. Libous was indicted last year for allegedly making a false statement to the FBI, when he was questioned about using his political influence to get his son Matthew a job at a Westchester County Law firm. Matthew Libous was found guilty last week on 3 counts of falsifying federal tax returns & he faces sentencing at a later date.

A Chinese Auction will be held to benefit local efforts to bring service dogs to veterans in need of help. State Police have charged 22-year-old Ryan Webster of Morris with DWI, after a crash late Wednesday night on state route 20 in Edmeston. Webster was airlifted by LifeNet to Albany Medical Center with fractures and internal injuries, after his motorcycle went off the roadway, hit a fence and a tree, he was also ejected.

The Chenango County Sheriff’s Office arrested 2 Town of Norwich residents for Neglect of an Impounded Animal. Charged were 53-year-old Keith Robinson and 64 year old Mary Randall, they are accused of keeping 4 dogs in crates for extreme lengths of time without cleaning the crates or having proper ventilation. Both will appear in the Town of Norwich Court at a later date.

WCDO NEWS THURSDAY 7-9-15

State Police issued over 10 thousand tickets to drivers statewide over the July 4th holiday weekend, which began on Friday and ended on Monday. State Police were cracking down on drunk drivers as well as other violators. Of the tickets issued, 4,523 were for speeding, 621 for seatbelt and child restraint violations, and 186 for failure to move over and 310 for distracted driving. Troopers arrested 198 people for DWI during the crackdown. They investigated 722 accidents where 198 people were injured and two people were killed.

A federal grand jury has indicted former Tennessee congressional candidate Robert Doggart for allegedly soliciting others in a plan to commit arson & murder at a Muslim community in Hancock. Doggart is accused of recruiting others through Facebook & by phone, to burn buildings and kill members of the community. The U.S. Department of Justice’s Civil Rights Division is prosecuting Doggart, following the investigation by the FBI, who arrested Doggart in April. Doggart was released on $30,000 bond and is currently subject to home confinement.

Governor Cuomo issued Executive Order No. 147, which appoints the New York State Attorney General as a special prosecutor in matters relating to the deaths of unarmed civilians caused by law enforcement officers.

The executive order allows the special prosecutor to review cases where there is a question whether the civilian was armed and dangerous at the time of his or her death. Cuomo said that the Assembly passed a bill this year dealing with the issue, the State Senate did not pass a bill due to small differences of opinion, Cuomo said the he expects a permanent law to be passed in 2016.

A group of Parents in the Harpursville Central School district, known as “STOP” has sued the school Board for violating open meeting laws. The lawsuit claims that the board voted to remove one administrator and reassign another in the elementary school, despite a number of parents voicing opposing the plans, the lawsuit also claims that the school board has not maintained the legally required minutes.

A New Siena Institute Poll shows the Upstate New York Residents feel that their economy is still lagging behind the rest of the country. The survey found that 41% claimed that gasoline prices are having a very serious or somewhat serious on their finances, 65% indicate said that the amount spent on groceries is having a very serious or somewhat serious effect on their finances.

Governor Cuomo announced that more than $18 million in economic development funding for 19 projects state wide. In the Southern Tier Region, Corning Diesel will receive $3,000,000 for the purchasing of machinery and equipment to support the company’s facility expansion in Steuben County. The Broome County IDA & Indian Valley Industries, will get $728,500 to acquire a manufacturing facility and to relocate within Broome County. The site of their existing facility is slated to be used for a new Pharmacy School in Johnson City.

Governor Cuomo signed the “Enough is Enough” Legislation Tuesday in New York City, to Combat Sexual Assault on private College Campuses:

The bill is based on action already taken in the State University System. The law is expected to become a national model on the issue of sexual assaults on college campuses.

The Broome County Sheriff’s Office is actively looking for a 16-year-old run away. Deputies responded to the Children’s Home of Wyoming Conference in the Town of Fenton, where Mia Rosado took a bus to the Elmira, area – but could still be in the Broome County area. Anyone with information can contact the Sheriff’s Office at 778-1911. Mia is 16 years old; light skinned Hispanic, brown hair & eyes, 5’5” tall, 130 lbs. Mia was last seen wearing a gray sweatshirt.

Tioga Downs Owner Jeff Gural is now the only one left with a proposal before the state gaming commission for a casino in the Southern Tier. Gural said that his plan calls for a 125 million dollar expansion, and should add about 500 jobs; a previous group out of Albany has dropped their proposal for a Broome County facility.

Binghamton Mayor Rich David announced that the City of Binghamton has reinstated Police Chief Joseph Zikuski. Mayor David stated that they reviewed an independent review of accusations against Chief Zikuski by the law firm of Coughlin & Gerhart. Mayor David said that the there were no complaints or evidence of harassment or discrimination by Zikuski, who was on a 60-day unpaid suspension that ended today.

On Friday July 3rd, members of the Delaware County Sheriff’s Office and Village of Hancock Police Department conducted a joint traffic safety check on State Highway 97 in the Village of Hancock that was funded by the Governor’s Traffic Safety Committee Police Traffic Services grant. 13 traffic tickets were issued, including 1 for Aggravated Unlicensed Operation of a motor vehicle & 2 tickets for unlicensed operation of a motor vehicle. On the same day Deputies participating in an Aggressive Driving Campaign issued 14 additional tickets for speeding and various other violations of vehicle & traffic law.

Delaware County Sheriff Deputies arrested 41-year-old Michael Carey of Oneonta for 1 count of Aggravated Unlicensed Operation in the town of Sidney,  Carey was found to have 11 active suspensions in effect. Carey was arraigned in the Town of Sidney Justice Court, posted bail and is scheduled to reappear on July 25th.

P.M. NEWS TUESDAY 7-7-15

State Police reported a plane crash Monday night at around 8:05 PM near South Martindale Road in the town of Milford. 55-year-old Edward Schoene of Springfield Center took off from the Oneonta municipal airport & had engine trouble, he landed the plane in a cornfield & was transported to Bassett hospital in Cooperstown, where he was treated fro injuries sustained in the crash. The FAA was contacted and will also be investigating this accident.

Scammers posing as the IRS, are targeting Senior citizens or Naturalized citizens, they are trying to get money from unsuspecting taxpayers, under the threat of possible arrest if they do not comply. Area Tax preparer George McLain told WCDO News that the IRS does not call citizens:

Governor Cuomo signed the “Enough is Enough” Legislation this afternoon in New York City. The legislation is designed to Combat Sexual Assault on private College Campuses, the bills are based on action already taken in the State University System, it passed both houses of the legislature this session, lawmakers hope to reduce the stigma of reporting sexual assaults, and make it easier to report the assaults to law enforcement agencies.

Delaware County Sheriff’s Deputies responded to a 911 report last Wednesday of a 1-car personal injury accident on State Highway 10 in the Town of Hamden. 68-year-old Thomas Jones of Hamden failed to negotiate a curve in the roadway after suffering an apparent medical emergency, he left the roadway and rolled his vehicle over an embankment, Jones was extricated from his vehicle & was airlifted by LifeNet Helicopter to Wilson Hospital in Johnson City for treatment of a head injury.

State Police arrested 26-year-old Denise Marin of Tioga for 3rd degree Assault, following a physical dispute at the Mirabito Gas Station on State Route 23 in the Town of Oneonta. Marin faces court action in the Town of Oneonta Court on July 14th.
