The Joint Landowners Coalition of New York will file its lawsuit against New York State today, The action seeks an Order: Compelling the DEC to finalize the environmental impact statement on hydrofracking, Determining that the DEC referral of the statement to the health department was arbitrary and capricious, & that Governor Cuomo is acting without jurisdiction by orchestrating the delay and interfering with the DEC’s independent decision-making authority.  The Coalition is represented by Mountain States Legal Foundation and Levene Gouldin & Thompson.

Delaware County Sheriff’s Deputies arrested 27-year-old Ashley Hoyt of Meridale on 1count of 2nd degree Aggravated Harassment for allegedly making numerous unwanted phone calls and text messages to another person.   Hoyt was issued a criminal summons ordering her appearance at the Town of Delhi Court on March 4th

The latest winter storm track has moved into a direction that will mean more snow accumulation to the Southern tier.  Sidney High School Meteorologist Rich Townsend explains:

Chobani’s quest to get its Greek yogurt to the Sochi Olympics is coming to an end. The shipment has been held up in a refrigerated warehouse at Newark Liberty International Airport since Russian authorities said the U.S. Department of Agriculture failed to provide a necessary certificate under its customs rules. Chobani will donate a shipment of about 5,000 cups of yogurt donated to New York and New Jersey food banks; they had hoped to send it to U.S. athletes at the Winter Games.

The Cuomo administration has proposed keeping pay flat, for the 6th straight year for caretakers of the disabled and others at state-funded non-profits. Most members of the Assembly signed a letter that urges a 2% cost-of-living increase in the state budget for the next fiscal year, they argued that continuing low pay forces many staff to work unsafe amounts of overtime or take 2nd jobs. The administration estimates saving $76 million, by deferring the 2% increase for human services workers.

The Chenango County Sheriff’s Office will host a Boaters Safety Course on Saturday from 8-4, at the Sheriff’s Office on county road 46 in Norwich. It is now required for residents to attend a Boaters Safety Course in order to operate any motorized watercraft on any public waterway. Governor Cuomo’s approval rating remains high at 63%, according to the latest Quinnipiac University poll. The poll also showed that Cuomo would defeat Westchester County Executive Rob Astorino by a 58% to 24% margin in the race for Governor, he would defeat Donald Trump by a 63% to 26% margin.   Astorino was also unknown to 86% of voters.  Astorino has formed a committee to study the feasibility for entering the governor’s race as the republican candidate.

State police have arrested a Port Crane man for allegedly driving at 92 miles an hour on I-81tuesday.  Troopers arrested 26-year-old Randy Nonneberg on a charge of aggravated unlicensed operation.   Nonneberg showed troopers an identification card only; a DMV Computer check showed that he had 7 active driving suspensions in New York.  Nonneberg was arraigned in the Town of Cortlandville Court and released to appear back on February 24th.

25-year-old Jaclyn Wesley of Binghamton has withdrawn a bid to remain free until her appeal is decided, she was convicted in a Broome County Court on 3 counts of 1st degree vehicular manslaughter & DWI, for driving drunk and crashing her SUV into the Chenango River off I 88 in Fenton on May 20, 2011. Wesley was sentenced last month to 3 to 9 years in prison, she returned to court January 31st after her attorneys requested that the judge postponed sentencing until an appeal was decided, that request was withdrawn. 25-year-old Rob Moorehead, 45-year-old Rob Marshall and 39-year-old Carri Michalski were killed in the crash.

The Sidney Middle School Student Council held a food drive January 27th through February 7th; they collected more than 1,836 cans of food. Proceeds went to the Sidney Food Bank.

Governor Cuomo’s staff will announce the boundaries of the tax-free zones for the program StartUp NY shortly.  The program erases all taxes for businesses willing to start up on SUNY campuses, some private campuses and some land near colleges. More information is available at startup-ny.com.

Governor Cuomo announced that 17 counties would compete for more than $13 million to fund efforts to reduce firearm-related crimes, shootings, and homicides through the state’s new Gun Involved Violence Elimination (GIVE) initiative. The initiative is designed to build upon the crime-fighting successes those jurisdictions experienced while participating in Operation IMPACT, locally, Broome County has been involved previously in Operation Impact.

The next winter storm has a difficult track to predict at this point, the track will determine how much snow accumulation this are will receive Thursday,  Sidney High School Meteorologist Rich Townsend explains:

Townsend said that if the track heads into the southern tier, the significant snowfall would be about 6 to 10 inches.

The autopsy on 39-year-old Richard McKee of Windsor was performed at Wilson Hospital, the cause of death was listed as a heart attack caused by cold-water immersion.  State Police reported that McKee was walking his property when he entered onto a section of ice over open running water, the ice broke and he entered the water up to his chest.  McKee was able to exit the water, but became unresponsive while walking back to his vehicle; he later died at Wilson Hospital.

Delaware County Sheriff’s Deputies investigated a 1-car accident on County Highway 18 in the Town of Delhi last Thursday.  22-YEAR-OLD Joshua Kaplan of Clifton Park was unconscious in the vehicle, he apparently suffered a medical crisis causing him to lose control & leave the roadway, where he struck an embankment. Kaplan was transported to O’Connor Hospital, & was then airlifted to Albany Medical Center for treatment for a skull fracture and brain injury.  20-year-old Andriana Senti of Port Crane was a passenger in Kaplan’s vehicle; she was not injured but was taken to O’Connor Hospital for evaluation. The investigation revealed that Kaplan had been physically assaulted by his roommate, 21-year-old Jonathan Lora of Middletown, earlier that evening, and the injuries Kaplan sustained led to the medical crisis while driving.  Deputies charged Lora with 2nd degree Assault; he was arraigned in the Town of Stamford Court and was released on recognizance pending further court action.

Governor Cuomo announced that more than 6,700 wage theft cases were resolved in New York in 2013, more than in any other year. This resulted in the disbursement of nearly $23 million to more than 12,700 workers who were not paid their proper minimum wage, overtime pay or fringe benefits. This represents an increase of more than 12 percent in the number of closed wage theft cases compared to 2012.

Governor Cuomo announced the start of business operations for the New York Green Bank, which will work to stimulate private sector financing and accelerate the transition to a cost-effective clean energy system. The New York Green Bank is seeking proposals from private sector lenders, investors and industry participants to facilitate the financing of clean-energy projects in the State.

6 former Binghamton Senators hockey players will represent their home countries, at the 2014 winter Olympics in Sochi Russia.  Sweden, Switzerland, the Czech Republic & Latvia will be represented.  The Olympic men’s hockey tournament begins today.  In honor of the Olympics, the B-Sens will be wearing special USA Themed Jerseys during this Saturday’s game at the Broome County Arena.  The jerseys will be auctioned off after the game.

The state Board of Regents voted to delay Common Core graduation requirements for five years, but a change to the state’s teacher-evaluation system was tabled until April.  The board adopted 18 changes to the state’s management of the Common Core. Now, the class of 2022—this year’s fourth-graders—will be the first to face the Common Core requirements for graduation, rather than the class of 2017—this year’s ninth-graders.

Smithville, Triangle, Greene, Oxford, and McDonough fire crews responded this morning to a house fire, that injured two occupants at 127 State Highway 220 in Smithville. A 71-year-old man and his 37-year-old grandson were living in the two-story home. The 71-year-old was airlifted to Upstate Medical in Syracuse for burns. The other victim was taken to Wilson Hospital for his injuries and then transferred to Upstate Medical. The severity of their injuries is unknown

Delaware County Sheriff’s Investigators arrested 40-year-old Kelly Abbes, also known as Kelly Zimmerman, for Criminal Sale of a Controlled Substance, 4th degree Conspiracy, Criminally Possessing a Hypodermic Instrument & Unlawful Possession of Marihuana.  Abbes is accused of selling Heroin in the Village of Stamford and then conspiring to obtain and sell Heroin, she was arraigned in the Town of Delhi Court and was ordered held in lieu of $20,000 cash bail.

State Police in Norwich arrested 27-year-old DARREN POLLOCK of Norwich on   10 counts of promoting a Sexual Performance by a Child.  Members of the Internet Crimes Against Children Task Force, State Police and Norwich City Police made the arrests following a joint investigation.  POLLOCK was arraigned in the Norwich Town court and remanded to the Chenango County Jail on $5,000 cash bail pending future court appearances.

P.M. NEWS TUESDAY 2-11-14

U.S. Marshals, State Police & the Binghamton Police Department Warrant Squad, arrested 70 year old Theodore Johnson of Binghamton on a federal warrant for narcotics conspiracy. JOHNSON was turned over to the DEA for arraignment in Federal Court in New York City; his arrest was in connection with a large scale investigation involving an unsealed indictment in Manhattan federal court in which 24 people were arrested for Oxycodone trafficking in the Bronx.

State Police investigated an accidental death at the Forest Lake Campgrounds in the Town of Windsor. 39-year-old Richard McKee Jr., of Windsor was walking the property & entered onto a section of ice located above open running water, the ice broke and McKee entered the water up to his chest.  Police reported that McKee became unresponsive while walking back to his vehicle, he was transported to Wilson Memorial Hospital, where he was later pronounced deceased. An Autopsy is scheduled for today.

State department of Taxation and Finance officials reported that e-filing continues to significantly advance over paper filing.  So far, more than 1.3 million taxpayers have e-filed their income tax returns, only 8,000 paper income tax returns have been submitted.  This year, almost all New Yorkers can prepare and e-file their State returns for free.

Funeral services will be held Saturday at 11:00 AM for Franklin Assistant Fire Chief Jim Wilber, at the Franklin central School.  A reception will follow at the Franklin fire Department.  Wilber died from heart related problems Sunday morning while responding to a motor vehicle accident for the Franklin Fire department, he had served in the Franklin & Wells Bridge fire departments for 40 years.  Fire departments planning to attend the funeral services should contact the Delaware county emergency services office at 746-9600.

Homeowners who receive an exemption under the state’s Basic STAR program faced a December 31st deadline to re-register in order to keep receiving the benefit as part of a plan to cut down on fraud. Since then, the state Department of Taxation and Finance has continued to accept late registrations on its website and will until March 7. But those who miss the March 7 deadline may not be out of luck. The governor’s sate budget proposal would allow the tax department to reimburse homeowners who register after receiving their school-tax bill this fall. Cuomo and lawmakers face an April 1st deadline to put a new spending plan in place

A state Board of Regents subcommittee adopted revisions to New York’s Common Core rollout, including making this year’s third-graders the first class to have to fully meet new state standards. If approved by the full board today, students will not need to hit new state targets on Common Core-based Regents tests in high school to graduate until 2022. Before then, students would still take the new tests, but will be able to graduate with lower scores. Previously, this year’s ninth-graders were to be the first to have to hit new state targets on the tests. A separate motion to freeze Common Core-based testing for grades 3-8 was defeated.

Businesses in the state can now save time and money by filing their Certificates of Incorporation and Articles of Organization online. The new online filing system allows business filings to be processed in minutes rather than a week, and eliminates the need to pay an expedited processing fee.  Governor Cuomo said by streamlining the process, it will lure entrepreneurs to do business in the state and create more jobs. The online filing system is available thorough the Department of State’s Division of Corporations website at dos.ny.gov

State police arrested 40-year-old Theodore Halstead of East Meredith for felony DWI with a BAC result of .19%.  The arrest resulted followed a stop for speeding on State Route 23 in Davenport, Halstead was charged with Felony DWI because he had a prior conviction for DWI within the last 10 years.  Halstead was arraigned in the Town of Davenport Court and released on his own recognizance.

Oneonta Police Department arrested 62-year-old Maxie Godfrey of Oneonta for 1st degree Criminal Sexual Act, for allegedly using forcible compulsion to engage in sexual acts with another person.   Godfrey is currently being held at the Otsego County Jail on other related charges and is scheduled to reappear at a later date.

New York State of Health reported that 696,880 New Yorkers have completed their applications and 412,221 have enrolled for coverage since the launch of the Marketplace last October. 66% of New Yorkers who have enrolled to date were uninsured at the time of application.  The open enrollment period for individuals runs through March 31st.

The Chenango county sheriffs department arrested 55 year old Max Welch of Afton on charges of DWI, driving with a BAC greater than.08%, unlicensed operation of a motor vehicle, felony aggravated unlicensed operation of a motor vehicle, and a turn signal violation.  Welch was charged following a traffic stop in the Village of Afton, he was found to be intoxicated, having an expired & revoked driver’s license, he was arraigned & was remanded to the Chenango County Correctional Facility on bail and will reappear in the Village of Afton Court at a later date.

State lawmakers will examine taxes, economic development and mental health care during the next round of budget hearings this week in Albany.  Governor Cuomo submitted a $137.2 billion budget plan to a joint session of the legislature last month, for the fiscal year starting April 1st.

Delaware County Fair President Danny Hodges announced this year’s grandstand lineup at a recent meeting in Walton.  Monday night will feature the Demo Derby, Tuesday’s highlight will be the Fireman’s Parade, Wednesday will be the NYTPA modified truck and tractor Pulls, Friday will feature the 2nd installment of the Demolition Derby, and Country Music act Easton Corbin will headline, with “The Voice” winner, Danielle Bradbury opening.  Tickets for all of these events will go on sale in the early spring.  The 2014 Fair will be held on August 11-16.

The Chenango County Sheriff’s department arrested 31-year-old Aaron McEligot of Norwich for 2nd degree Aggravated Harassment.   McEligot was charged on an arrest warrant was forwarded by Town of North Norwich Court; he was located in North Norwich and was taken into custody without incident.  McEligot was arraigned in the Town of Norwich Court, and will reappear in the Town of North Norwich Court at a later date.

A 20-year-old bill to make it easier for adoptees over the age of 18 to get their original birth records is up again in the state Legislature. Supporters of the Bill of Adoptee Rights argue that information from unsealed birth records is vital to the medical and mental health of adoptees, while opponents claim easing disclosure rules could violate a biological parent’s privacy.

Now that the Federal farm Bill has been passed, the agricultural community can proceed to thrive in New York State with a definite plan in place, and federal money coming to fund programs.  Chenango County Farm Bureau director Bradd Vickers said that the bill covers a lot more than most people think:

President Obama signed the farm bill last week; it took congress more than 2 years to reach an agreement on the 5-year plan.

Governor Cuomo’s state budget proposal includes an additional $3.2 million for personnel costs related to the SAFE Act.  State police Superintendent Joseph D’Amico said the money will go toward hiring civilian employees to help with administrative duties related to the gun laws, including the processing of assault-weapon registrations and maintaining records. The budget also includes about $27.7 million for information technology costs, including the creation of a statewide database for background checks on ammunition purchases.

The state Republican convention this year will be held in Westchester County. The convention will be held on May 14th  & 15th at the Hilton Westchester in Rye Brook, No Republican has formally declared for the 2014 governor’s race, though the Westchester County executive Rob Astorino opened an exploratory fundraising committee last week. The location of the Democrats’ 2014 convention has not yet been announced.

The Chenango County Sheriffs department arrested 47-year-old Leon Beckwith of New Berlin for 2nd degree Harassment & resisting arrest.  Beckwith was charged after acting aggressively with an investigating deputy, he was arraigned was remanded to the Chenango County Correctional Facility on cash bail, he will reappear in the Town of New Berlin Court at a later date.
