Constitution Pipeline Company has appealed the State DEC’s refusal to grant the company’s request for a Section 401 Water Quality Certification under the Clean Water Act. The appeal was filed with the U.S. Circuit Court of Appeals, they contend that the refusal is arbitrary and capricious and constitutes an impermissible challenge to the Federal Energy Regulatory Commission’s Certificate of Public Convenience and Necessity, which was issued in December 2014. The company also filed an action with the U.S. District Court seeking a declaration that the State of New York’s authority to exercise permitting jurisdiction over certain other environmental matters is preempted by federal law.

State Police responded to a Delaware County 911 report of a motor vehicle accident on West Kortright Church Road in the Town of Kortright, Monday at around 5:45 PM. Troopers determined that 58 year old Michael Berry of East Meredith, lost control of his pickup truck, he left the roadway, struck a culvert, & overturned. Berry was transported to Fox Hospital in Oneonta where he was pronounced deceased from internal injuries. The investigation is ongoing.

Governor Cuomo today announced that New York State will award $1 million each to Bard College, University at Buffalo and SUNY Broome as part of the “Energy to Lead Competition, ” which challenged student-led coalitions to design and develop plans for clean energy projects. SUNY Broome’s “Geothermal Learning Laboratory” project shows how a geothermal system can harness the energy stored in the earth to heat and cool a campus, serve as a hands-on learning resource for students, and generate energy bill savings that can be reinvested in energy conservation measures. The project is expected to result in the avoidance of 135 metric tons of greenhouse gas emissions annually.

Supporters came from all over to show their support for the residents of Islamberg in the town of Tompkins, as a group of Bikers known as the “American Bikers United Against Jihad” planned a rally, against the Muslim group who have been targeted in certain media as being a terrorist training ground. Julia Reischel of the Watershed Post was at yesterday’s rally; she told WCDO News that the rally was a lot smaller than expected:

Reischel said that state Troopers & Delaware County Sheriff’s deputies were on hand to insure the safety of the community & the supporters. Islamberg had also been targeted by Robert Doggart of Tennessee, who vowed to get a militia together to burn down the community and kill the residents; he was arrested earlier this year by the FBI for making terrorist threats.

Tomorrow is school budget vote day across the state. Locally, 2 area school districts managed to lower the tax levy slightly; they were the Milford & Afton School Districts. School that have the tax levy unchanged from last year are Walton, Delhi, Charlotte VALLEY, Deposit, Oxford Academy, Laurens, Gilbertsville Mount Upton, & Morris. Slight increases in the tax levy were in Unatego, Bainbridge Guilford, Oneonta, increases of 1% or more are proposed in the Unadilla VALLEY & Norwich Districts, 2% or more were proposed in Sidney, Greene & Franklin and more than 3% increases were proposed in Harpursville & Windsor. State officials said that the tax cap for the tri-county region was tabulated at roughly 1%.

Johnson City Police Patrolman Lou Cioci was presented the Congressional Medal of Valor by President Barack Obama this morning at the White House. Cioci was recognized for his actions on March 31st 2014, after fellow Johnson City Police Officer David Smith was shot and killed on Harrison Street, as Patrolman Cioci arrived, he opened fire on the gunman, hitting him several times, The injured gunman tackled Cioci, attempting to grab his service weapon, Cioci shot the man twice more during the confrontation, ending the attack.

State Police arrested 47-year-old Albert Hughes of the town of Maryland for Aggravated DWI with a B.A.C. result of .23%, plus other traffic tickets. The arrest occurred after troopers responded to an Otsego County 911 report of a one-vehicle property damage accident on State route 7 in the Town of Oneonta. Hughes drove into a guide rail and caused damage, he was issued tickets returnable to the Town of Oneonta on May 24th.

Delaware County Sheriff Deputies arrested 40-year-old Ian Lyle of Unadilla on one count of DWI following an investigation of a one-car motor vehicle accident in the Town of Sidney. Lyle was additionally charged with making an unsafe lane change and was released on tickets returnable to Sidney Town Court at a later date.

Governor Cuomo today announced $20 million in federal funding to support the State’s efforts to get unemployed New Yorkers back to work. The grant is the largest awarded to any state and exceeds last year’s total of $18 million. The southern tier will receive $818,516 in federal support.

Governor Cuomo announced that he is advancing legislation to end the HIV/AIDS epidemic in New York State. The legislation would Increase the number of individuals who will be linked to and remain in care by allowing HIV-related information to be shared with care managers. It would Streamline HIV testing efforts and extends the upper age limit of the beyond the current age of 64. It would Make clear that minors have the right to obtain life-saving HIV treatment and preventive services without parental consent & it would Expand the opportunities for STD screening and access to post exposure prophylaxis to prevent infection.

Congressman Chris Gibson announced the passage of 18 bills aimed at combating heroin and opioid abuse. The Comprehensive Addiction and Recovery Act would improve the use of opioid therapy and pain management in treating veterans; amends federal law to impose penalties for extraterritorial drug trafficking and production of precursor chemicals used for illegal drugs; clarifies when a prescription for a drug like oxycodone may be partially filled; & amends the Controlled Substances Act to expand access to medication-assisted treatment for people suffering from addiction.

Firefighters responded on at about 1:30 Sunday afternoon to a Structure Fire on Dunk Hill Road in Walton. Walton Firefighters received aid from Franklin, Delhi, Trout Creek, Bovina & Otego. Walton Fire fighters reported that the Fire was Called in by an alarm company, as a small fire in the wall of the building on the 2nd floor, the fire spread to the roof. The fire was under control at about 6:00 PM, no injuries were reported. Walton Firefighters were called back to the site at about 11:30 this morning for the report of a rekindle.

Oneonta Police Department served a search warrant late Wednesday afternoon on two apartments at 2 Cliff Street, they discovered 2.5 pounds of marijuana, 185 Xanax pills, 120 packages of marijuana edibles & over $9400 cash. Police arrested 25 year-old Cody Schlafer and 33 year-old Bryan VanDuesen for Criminal Possession of a Controlled Substance, Criminal Possession of Marijuana, & 4th degree conspiracy. Both face court action shortly, the investigation is continuing.

State Police arrested 31-year-old James Cooke of Bainbridge for DWI & Several traffic violations, following the investigation of an accident in Bainbridge last night. Cooke registered a BAC of .16, twice the legal limit, following the 2-vehicle accident on State Route 206 in the Town of Bainbridge. Cooke failed to stop in time and drove into a vehicle that was stopped in traffic ahead of him. The driver of the other vehicle had neck pain and was transported to Tri-Town Regional Hospital in Sidney. Cooke was issued tickets returnable to the Town of Bainbridge Court on May 19th.

State Police were attempting to locate a 14 year old suspect who was wanted for a menacing with a weapon in Windsor in April, while trying to locate the juvenile, Troopers allege that 29 year old Jessie Bolster & 74 Year old Faith Lynch, harbored the suspect at their home on Fox Farm Road in the Town of Windsor. The 14 year old suspect was later located and arrested, & was transported to a juvenile facility, Bolster and Lynch were arrested for hindering prosecution, Bolster was arraigned in the Town of Windsor court and was remanded to the Broome county jail on bail. Lynch was issued a ticket returnable to the Town of Windsor court on May 18th.

Police have identified the body of the woman found in the Chenango River as 37-year-old Brenda Halpin, who had been missing since April 8 from her Chenango Bridge home. The identification was announced Thursday after fingerprint comparison and analysis was performed, according to the Broome County Sheriff’s Office. An autopsy was conducted Wednesday, and the cause of her death was ruled as freshwater drowning. Halpin’s body was found just before 2 p.m. Tuesday by a man walking along the riverbank in Port Dickinson, in the 600 block of Chenango Street.

29-Year-old Amanda Hellman of Vestal pleaded guilty Thursday afternoon in Broome County Court to 2nd degree kidnapping. Hellmann faces Sentencing on July 11th, Hellmann kidnapped 14 year old Shaeleen Fortner & 16 year old Kylea Fortner, they were located in March, 47 year old Cindy Fortner who is the girl’s biological mother, was also charged in connection to their kidnapping, she is being held in the Broome County Jail pending court action.

Deposit Police have arrested 20-year-old Jonathan Hafele of Deposit, after an investigation into a burglary complaint in the Village where several firearms were stolen. Hafele was charged with 9 counts of 4th degree Grand Larceny & 1count of Offering a false instrument for filing; he was arraigned in the Village of Deposit Court and remanded to the Delaware County Correctional Facility on $10,000 bail pending further action of the Court.

Former State Senate leader Dean Skelos was sentenced to 5 years in prison on corruption charges today, his son, Adam received a 6 1/2 year sentence in a Manhattan federal courtroom today. Skelos used his position in state government to pressure businesses to provide his son with $300,000 no-show job in exchange for political favors.

A 2-year investigation by Environmental Conservation Officers uncovered an illegal venison sales operation in South Edmeston. Officers executed a search warrant at Farmers Place on County Highway 20 and found more than 3,600 pounds of illegal venison meat and products. 73-year-old Joseph Leonard was charged with Felony Illegal Commercialization of Wildlife, Felony Grand Larceny, Criminal Solicitation, and Illegal Scheme to Defraud, for allegedly selling venison to undercover investigators. 57-year-old Tamra Hoag was also charged with Illegal Commercialization of Wildlife and Illegal Scheme to Defraud, they were arraigned in the Town of Edmeston court and are due back in court on June 6th.

State Comptroller Tom DiNapoli today called for changes to the state’s fiscal practices, including limiting discretionary lump sum spending, restricting “backdoor spending” by public authorities and imposing a constitutional limit on state debt, among other reforms, to bring increased transparency and accountability to state finances. State Police at Sidney arrested 41-year-old Danielle Pettit of Bainbridge, for criminal mischief, after troopers responded to a Chenango County 911 report of criminal mischief on Kelly Road in the Town of Bainbridge. An investigation determined that Pettit had damaged the windows of a parked car and then left the scene. The windows had a value of more than $250. After being located, Pettit was arraigned in the adjoining Town of Afton court and was remanded to the Chenango County jail in lieu of $5,000 cash bail or $10,000 property bond. Her next court date in the Town of Bainbridge Thursday.

The Broome County Sheriff’s Office is investigating the discovery of human remains, after an area man was walking along the Chenango river bank around 1:55 Tuesday afternoon, & he found remains behind a house in the 600 block of Chenango Street in Port Dickinson. An autopsy is scheduled for Wednesday.

The Broome County Sheriff’s Office Detective Division arrested 49 year old Matthew Ahearn of Harpursville, for failing to register with the State Sex Offender Registry. The Broome County Sheriff’s Office Detective Division received a tip that Ahearn had moved to Harpursville and failed to report his address change within the proper time period; he was arraigned and was sent to the Broome County Sheriff’s Correctional Facility on $500 cash or $1000 property bail

Governor Cuomo today announced the launch of a statewide heroin task force charged with ending the heroin and opioid crisis in New York. The group is a coalition of experts in healthcare, drug policy, advocacy, education, and parents and New Yorkers in recovery, will build on the state’s previous efforts and use their expertise and experience to develop a plan to combat the state’s opioid epidemic. Members of the task force will hold public listening sessions across New York to inform their recommendations.

A Broome County Grand Jury has indicted 2 people in connection with an incident involving gunfire at the SUNY Broome Dorms. 20-year-old Jermain Carr and 19-year-old Derris Robinson were each charged with felony Reckless Endangerment & criminal possession of a weapon for the incident last October 29th.

The Broome County Sheriff’s department has been searching for 37-year-old Brenda Halpin of Chenango Bridge for over a month, since she disappeared from her home, without medication for health issues, which includes the degenerative Huntington’s disease. Halpin was last seen April 8th in the Poplar Hill Road area; her family is offering a $10,000 reward for information leading to her whereabouts. Halpin is described as a White Female, about 5 feet tall, about 90 pounds, with long straight brown hair, Huntington’s diseases makes it difficult for her to sometimes walk or communicate clearly.

Harmon said that there used to be a few weeks difference between the Wessels and Clinton Races, which made it difficult for paddlers from outside the area to make 2 separate trips, paddlers would often chose just one race to participate in. Governor Cuomo today honored 26 police officers who made the ultimate sacrifice in service to communities across New York State. The officers from six local, state and federal law enforcement agencies were remembered at New York State’s annual Police Officers’ Memorial Remembrance Ceremony. Their names joined 1,387 others on the granite memorial at the Empire State Plaza in Albany.


Otsego County Sheriff’s Department & Oneonta City Police arrested 26-year-old Haley Cornell of Oneonta, 26-year-old Shakeem Enang of the Bronx & 31 year old Michael Lightly of the Bronx on a variety of drug charges Sunday morning at 2 Rose Avenue. Officers seized heroin, crack cocaine, Oxycodon, hydrocodone, marijuana, hypodermic needles and $1,834 in cash. All three were charged with Criminal Possession of a Controlled Substance, Enang and Lightly were charged with Criminal Sale of a Controlled Substance & Unlawful Possession of Marijuana, and Cornell was charged with Possession of a hypodermic instrument. All 3 were remanded to the Otsego County Jail on Cash bail pending future court action.

State Police arrested 36-year-old Michael Hall of South Otselic, for DWI & 2nd degree assault plus several other traffic violations. Troopers also charged Hall’s Girlfriend, 25-year-old Ashlee Simms of South Otselic, for DWI & other traffic violations. Troopers responded to a report of a woman yelling for help on South Chenango Street extension in the Town of Greene. Simms had been in a physical dispute with her boyfriend Hall who was a passenger in her vehicle, she stopped and ran for help, and Hall attempted to drive away & backed into a ditch and then fled on foot. Hall was arraigned and was remanded to the Chenango county jail on $250 cash bail or $500 property bond. Simms was also arraigned and was released without bail required. They face court action in the Town of Greene court on Thursday.

State Police arrested 53-year-old Kenneth Hines of Brooklyn for aggravated unlicensed operation and other traffic violations. This arrest occurred after a trooper observed Hines speeding at 92 mph, when the posted speed limit is 65 mph, on Interstate 81 southbound in the Town of Barker. An investigation determined his New York driving record showed him having 57 suspensions and revocations on 20 separate dates. Hines was arraigned in the adjoining Town of Fenton court and was remanded to the Broome County jail with no bail set at this time. His next court date in the Town of Barker court is pending.

Sidney Village Police arrested a local couple on drug & weapons charges. Police arrested 41-year-old Elizabeth Roettger (Rote-te-ger) for criminal possession of a weapon, criminal possession of a controlled substance, and controlled substance not in its original container, and 42-year-old Christopher Roettger for criminal possession of a weapon unlawful possession of marijuana. Both were arraigned in Sidney Village court & were remanded to the Delaware County jail on $5,000 Cash Bail & $10,000 bond.

The Broome County Sheriff’s Office is releasing the names of the persons involved in the fatal accident on East Maine Road on May 8th. 32-year-old Thomas Steyer of Binghamton was operating a Cadillac Escalade on East Maine Road; he collided with a Toyota Camry operated by 17-year-old Jontay Card of Binghamton, causing significant damage and multiple injuries. The front seat passenger in the Toyota, 17-year-old Dashaen Pabon of Endicott suffered a serious head injury and was transported to Wilson Hospital. The rear seat passenger, 4-year-old Samrya Oakley, of Johnson City suffered traumatic injuries and died at the scene. Both Steyer & Card were transported to Wilson Hospital for head injuries, Steyer was treated and released. The cause of the accident is still under investigation.

State Police arrested 43-year-old Donald Card of Endwell for robbery, intimidating a witness & unlawful possession of marihuana. Troopers responded to a report of a robbery at home on Delaware Avenue in the Town of Union, last Thursday night, where Card had allegedly forcibly took a wallet with money and valuables from a victim in a wheelchair and fled the scene. Troopers responded to the same location early Friday Morning as Card had returned and was threatening the victim, broke a window & fled the scene. Card was arrested at his home, he was arraigned and was remanded to the Broome County jail with no bail set at this time.

The Otsego County District Attorney’s Office reported the arrest of 45-year-old Kevin Blush of Milford for 2nd degree rape & child endangerment. Blush is accused of performing sexual acts with a female under the age of 15; he was arraigned in the Town of Hartwick and remanded to the Otsego County Correctional Facility on $5,000 bail. He faces court action on May 11th. A temporary order of protection was issued for the victim.

State Senator Jim Seward announced a $50,000 state grant he secured to help with improvements at Copes Corners Park in the Town of Butternuts. The capital funding has been used to help with improvements to the park’s bathroom facilities, pavilions, and purchase of playground equipment, it was included in the 2015-16 state budget and secured by Senator Seward through the New York State and Municipal Facilities Program.

The Broome County Sheriff’s Office investigated an April complaint of Identity Theft, which resulted in the loss of $3000 from the victim. Deputies have arrested 41 year old Loretta Parliman of Port Crane, for 1st degree Identity Theft, Criminal Possession of a Forged Instrument & Grand Larceny. Parliman was arraigned earlier this morning, future court action is pending.

Chenango County 911 Center received a call at Thursday at 7:48 PM from 305 Blanding Road in the Town of Sherburne, of an ATV accident involving a 14-year-old male. The Sheriff’s Office responded along with the Sherburne Fire Department, Norwich Fire Department and Cooperstown Medical Transport ambulances to find the ATV operator had been pinned face down under the overturned ATV, after apparently striking a piece of farm equipment & going over an embankment. The unidentified operator from Madison as taken to Chenango Memorial Hospital where he was pronounced deceased.

Governor Cuomo today announced more than $23 million in savings over a two-year period for farmers across the state as a result of the Agricultural Land Assessment Cap. First signed into law by the Governor in 2013, the cap prevents agricultural assessments from being increased by more than two percent per year. The previous cap was set at 10 percent. Regional Savings in the Southern Tier is about $2.1 million dollars.

Governor Cuomo today announced that over $10 million has been returned to more than 17,000 victims of wage theft during the first three months of 2016. This amount surpasses last year’s first quarter total of $9 million and places the state on track to exceed the $31.5 million in stolen wages recovered in 2015 – the highest ever. In the southern tier, over $74,000 was recovered for 149 workers.

A former Delaware County Sheriff sergeant was indicted by the Delaware County Grand Jury Thursday for attempting to murder. Theodore Tiska of Masonville was indicted for second-degree attempted murder and first-degree assault for attempting to intentionally cause the death of his wife on April 18 in the town of Masonville. Tiska is being held on $5,000 cash bail or $10,000 bond; He is scheduled to be arraigned in Delaware County Court on May 9th.
