The Federal Energy Regulatory Commission has found that New York waived its water quality authority for Williams’ Constitution Pipeline, giving new life to a natural gas project stalled since April 2016 when the state DEC denied a permit.   Federal regulators have cleared the way for the Constitution pipeline project to move forward, if the company still plans to do so.  The original plans called for the pipeline to run from Pennsylvania through the Susquehanna River Valley to the Capital Region, Williams Partners appealed to federal courts after New York rejected a water quality permit over concerns for 250 streams. The project still needs a permit from the U.S. Army Corps of Engineers.

Governor Cuomo today signed legislation closing the legal loophole that allows creditors to use New York courts to secure confessions of judgment and seize the assets of borrowers for cases where the borrower has no connection to New York. Prior to this new law, creditors were able to exploit New York laws to freeze and seize a borrower’s assets by obtaining a judgment entered in a court far from where the contested agreement was executed, making it difficult for a borrower to legally contest the unfair penalty.

The State DEC invites Public Comment about Proposal for No Further Action at the Amphenol Superfund Site on Delaware Avenue at dec.ny.gov until September 20th.  The DEC has also scheduled a public meeting on September 4th at 7:00 PM at Sidney Civic Center to discuss the proposed remedy and accept public comments.

A recent audit of the Village of Bainbridge found only 1 issue to be cleared up, after the village had spent over $4,000 at Barnard’s Hometown Hardware, while owner Erik Barnard was serving as a Village Trustee.  Bainbridge Mayor Phil Wade comments:

Mayor Wade said that Barnard submitted his resignation in July, & that there was no intentional wrongdoing, and he hoped that Barnard may revisit public service in the future.

The State Division of Budget announced today that they are approving the State Board of Elections’ plan to distribute $10 million to county governments to support early voting implementation.  The State Budget allocated $24.7 million for assistance with implementing a series of election law reforms, including early voting. The State Board of Election’s Aid to Localities Plan can be viewed at nysac.org.

Governor Cuomo announced that temporary lane closures for road and bridge construction projects on New York State highways will be suspended now until Tuesday, at 6:00 AM, to accommodate travelers during the busy Labor Day weekend.  Governor Cuomo is urging motorists to follow the state’s Move Over Law & that state and local law enforcement will be participating in the statewide “Drive Sober or Get Pulled Over” enforcement through Monday.

Delaware County Sheriff’s department announced that a 51-year-old Town of Sidney man reported missing on June 27th was located deceased on Wednesday afternoon.  Human remains were discovered by utility line employees working in a wooded area near the intersection of Lawton Hill Road and Franklin Depot Road in the Town of Sidney.   Deputies and Investigators identified the remains as those of Byron Furman who had been reported missing from his Lawton Hill Road residence.  Delaware County Medical Examiner Dr. Richard Ucci determined that Furman died of natural causes.

State Police and the DOT are continuing “Operation Hardhat,” as they try to crack down on work zone violations and promote safe driving through active work zones on state highways.  State Trooper are patrolling active work zones on I-81 in Broome and Route 17 in Tioga County; on Wednesday troopers issued 21 tickets in the I-81 work zone on Interstate 81 in Broome County, 16 were cell phone tickets, 2 for the Move Over Law, 2 for Moving From a Lane Unsafely & 1 for a seat belt violation.

Governor Cuomo today signed Erin’s Law on to New York’s books today.  The law requires public schools to teach age appropriate child sexual abuse and exploitation prevention classes to students in kindergarten through eighth grade. Erin’s Law is named for Erin Merryn, who is an abuse survivor and activist against child sexual abuse, the law will take effect on July 1, 2020.

Governor Cuomo signed a new law designed to spare victims of domestic violence some penalties on some of their utility bills.  The law allows people fleeing their batterers to terminate multi-year telephone or cable contracts at the home they’re leaving without paying a penalty; it covers victims who have received an order of protection.  The law takes effect immediately.

The Broome County Sherriff’s Office is warning people about a new phone scam where people posing as law enforcement.  Victims are receiving calls from a caller claiming to be a deputy & that the victim missed a jury duty assignment and needs to complete paperwork and pay a fine to avoid being arrested.  The caller requests the victim to meet in the parking lot of the Sherriff’s office and wait there to pay the fine.  The Sherriff’s department does not collect fines and official transactions are processed inside their office.  Anyone who has received this call should report it to 778-1191, extension 1.

U.S. Senator Kirsten Gillibrand is dropping out of the presidential race, after she failed to make the cut for the next Democratic candidate’s debate next month in Houston. Gillibrand announced her decision on Twitter also after low poll numbers and difficulty in raising funds.  Gillibrand was appointed to the Senate in 2009 to fill the seat vacated by Hillary Clinton, after she had served this region in the U.S House of Representatives.

Norwich City Police have charged a 3rd person in connection with the beating on Lackawanna Avenue recently that left the victim with a skull fracture & blind in 1 eye.  30 year old Tyrone Lester Jr., of Norwich was charged with 1st-degree assault, he is accused of participating in the assault along with Jonathan Booker and Hannah Bard, all 3 face additional court action.

New York State’s Marijuana Decriminalization Law went into effect today.  The law was signed by Governor Andrew Cuomo last month and reduces penalties for possession of small amounts of marijuana and allows for records to be expunged for people with certain marijuana convictions. President Trump has signed the Family Farmer Relief Act, which eases the process of reorganizing debt for farmers through Chapter 12 bankruptcy rules. 19th District Congressman Antonio Delgado introduced the legislation in April with bipartisan support.  The legislation passed the House on July 26, the Senate on August 2nd.

The National Center for Arts Research at Southern Methodist University in Dallas released their 5th annual Arts Vibrancy Index Report, which ranks more than 900 communities across the nation, examining the level of supply, demand, and government support for the arts.  Oneonta ranked 8th, Jackson, Wyoming ranked 1st, & Hudson New York ranked 5th, as the only other New York community in the survey’s Top 10. more information is available at oneonta.ny.us.

Area Police are investigating a burglary with vandalism at the Super Heroes in Ripped Jeans Thrift Shop in Oneonta over the weekend.  The store serves as a fundraising mechanism for the organization that has adoptable animals; the store is located at 4 South Main Street in Downtown Oneonta.

Governor Cuomo today signed legislation requiring industrial development agencies to live stream in real-time and post video recordings of all open meetings and public hearings. The video recordings must be posted online within five business days of the meeting or hearing and remain available for at least five years.

Binghamton Police are asking the public for assistance in trying to locate 73-year-old James Andrews, was last seen outside at home at 19 Gregory Lane earlier this month.  Andrews suffers from undisclosed health issues, he is described as 5’ 8″, 155 pounds, with blue eyes and grey hair, anyone with information should contact the Binghamton Police Detectives division at 772-7080 or the Binghamton Police Desk at 772-7076.

UHS Chenango Memorial Hospital’s capital campaign received a commitment from Blueox Corporation, in the amount of $50,000.   The capital campaign will support construction of a new Emergency Room and Walk-In Center, as well as strategic investments in Diagnostic Imaging and infrastructure to support the growth of future services. A vigil for SUNY Oneonta student Nicholas Stagnitta of Patchogue Long Island will be held tonight at 7:00 PM, in the President’s Garden on the SUNY campus.  Stagnitta was found dead in his apartment on Chestnut Street of an apparent suicide on Saturday, the vigil is open to the public.

A State Supreme Court Judge upheld a New York state law repealing religious exemptions for vaccines required for children in schools or day care programs.  The state Legislature repealed the religious exemption in June after nation’s worst measles outbreak in decades started in Rockland County.  Religious groups sued the state but the law was upheld by Friday’s decision.  New York allows exemption from vaccines for medical reasons such as a weakened immune system.

The Annual Bainbridge Glow Run will be held on September 14th at General Clinton Park in Bainbridge.  The event began in 2015 after Heather Bucalos of Sidney finished her treatment for Hodgkin’s Lymphoma and decided to hold fundraisers for area cancer patients.  This year, Heather has suffered a relapse & her friends are teaming up to raise funds for her with the Glow Run Fundraiser, Bucalos talked to WCDO News this morning about the activities scheduled for that day:

Delaware County Sheriff’s Deputies arrested 25-year-old Alizabeth Ramos of Brooklyn Friday evening, on a charge of Aggravated Unlicensed Operation of a Motor Vehicle, following a traffic stop on in the Town of Masonville. Ramos was also issued tickets for Unlicensed Operator, and Speeding, she was released on an appearance ticket and is scheduled to return to the Town of Masonville Court at a later date.

Governor Cuomo signed legislation Friday to stop Pension Poaching, which occurs when financial planners, insurance agents or others claim they are assisting veterans and their families get federal benefits, but are really convincing veterans to reposition their assets to qualify for benefits they are ineligible for, the poachers then sell the veterans unneeded financial products or services.  The bill will take effect in four months.

Oneonta Police responded Saturday to a residence on Chestnut Street, for a report of a deceased person.   Officers discovered 20 year old Nicolas Stagnitta from Patchogue, Long Island, who was a student at the State University at Oneonta, the initial investigation and autopsy revealed that Stagnitta took his own life; however, the investigation is continuing pending results of toxicology testing.

The Hancock Fire Department and EMT’s were dispatched Saturday to Jensen’s Ledges for a report of a 10 year old boy who had fallen off the ledges.  The Hancock Fire Department  rope rescue team performed a high angle rope rescue to extricate the boy within 1 hour and he was transported down the mountain in a UTV & was transported by LifeNet to a pediatric trauma center with life threatening injuries.

The Dormitory Authority has issued approximately $482 million in low-cost, tax-exempt bonds on behalf of 54 school districts across the state as part the School Districts Revenue Bond Financing Program, for fire protection, security, and air quality systems upgrades; renovations, Athletic field improvements; and technology updates.  Locally, the Norwich City School District receives $7,430,000, Sidney Central School District gets $9,820,000 & Unadilla Valley Central School District gets $6,890,000.

State Police at Troop C in Sidney announced that a 5-year-old and her dog, who were reported missing in the town of Franklin, were located safe & sound this afternoon at about 1:15 PM.  State Police Aviation was able to spot Destiny & her dog in a tall grassy area and direct troopers and emergency personnel to her location.  Police and several other agencies were dispatched this morning to the area of Grange Hall Road and State Route 28 in the town of Franklin.  State Police said that Destiny and her puppy were located several hundred yards from the area where they were reported missing.

Delaware County Sheriff’s Deputies and members of the Delhi Fire Department and Emergency Squad responded to a 911 report of a serious personal injury motorcycle accident on State Highway 10, near Betts Hill Road, in the Town of Delhi.  The Investigation revealed that 46 year-old Daniel Quackenbush of Delhi was traveling south on State Highway 10 when he lost control of his motorcycle which ran off the southbound road shoulder before striking an embankment and rolling over in the ditch,  ejecting Quackenbush,  who sustained serious injuries.  Quackenbush was taken to O’Connor Hospital in Delhi where he later succumbed to his injuries.  Deputies believe alcohol use contributed to the cause of the accident.

New York’s “Red Flag” bill goes into effect tomorrow.  The bill allows for Law enforcement, district attorneys, school officials and family members to request a confiscation of firearms from an individual who has been deemed a threat to themselves or others.  The bill would also prohibit people who are at high risk of using a firearm to hurt themselves or others to purchase weapons.

The State Comptroller’s office audited the City of Norwich Emergency Medical Services Billing practices, they discovered that the EMS Department did not bill for 614 incidents resulting in $417,600 of unbilled medical services and inaccurately billed 9 incidents totaling $8,300; this equates to approximately $200,000 in lost revenue at the current rate of collection.  The EMS Department had 903 unserviceable incidents resulting in approximately $400,000 in unrecoverable costs.  Norwich City officials disagreed with some of the audit’s findings, but indicated they have initiated corrective action.

State Police responded to Town Brook Road at Red Rock Road in the town of Stamford to a report of a propane truck in a ditch and on its passenger side.  An investigation revealed that for an unknown reason, possibly medically related, 62 year old Edward Walley of Delhi drove off the roadway, into a ditch and struck a utility pole before rolling to its passenger side.  Walley was not wearing a seatbelt at the time of the crash.   An autopsy is scheduled for later today, the investigation is continuing.

The Otsego County Sheriff’s Office arrested 2 people on a variety of drug charges after a search warrant was executed in the town of Worcester.  Deputies arrested 30 year old Jesse Wilson & 29 year old Samone Van Buren, they seized crack cocaine, suboxone, marijuana, $2,000 in cash, drug paraphernalia,   and Wilson and VanBuren were arraigned in the Town of Worcester Court and sent to the Otsego County Jail on $25,000 cash or $50,000 bond pending court action on September 3rd.

Former Cooperstown teacher Justin Hobbie pleaded guilty to 3 counts of sexual exploitation of a child.  Hobbie was accused of persuading girls under the age of 16 of sending him explicit videos.  Hobbie will be sentenced in December he will likely serve jail time & will be required to register as a sex offender.

Governor Cuomo signed legislation strengthening protections for minors against felony sex offenders. The law prevents minors from being placed in the custody of an individual who has been convicted of rape in the first or second degree, sexual conduct against a child in the first degree or predatory sexual assault against a child, it also prevents sex offenders from having unsupervised visits with a person who has been convicted of a felony sexual offense against the subject of the visitation order.

New York state farms generated $5.7 billion in revenue in 2017, according to a report released today by State Comptroller Tom DiNapoli.  New York has 33,400 farms, employs more than 55,000, farmland covers 23% of the state’s total land area,   New York ranks second nationwide for the production of apples and maple syrup, ranks third for grapes and eleventh for beer.  New York is the third largest producer of wine, with its wineries producing nearly 32 million gallons in 2017. Governor Cuomo signed legislation allowing victims of domestic violence to seek damages against individuals who fail to obey or enforce an order of protection; expanding the eligibility for victim compensation to victims of unlawful surveillance crimes who did not suffer a physical injury and expanding the definition of “child victim” to include children who witness a crime to ensure those children are eligible for victim compensation and assistance.

31 year old Johnnah DeGraw of Deposit pleaded guilty Tuesday to Federal Charges of conspiracy with intent to distribute a controlled substance.  DeGraw was arrested along with Marlon Graham in Deposit last November, for selling methamphetamines & fentanyl, she is already serving a 12 year sentence on drug charges in a State Prison, she is due to be sentenced on the federal guilty plea later this year.

Governor Cuomo cut the ribbon to open the 172nd Great New York State Fair this afternoon in Syracuse.  The State Fair runs through September 2nd with food, exhibits, & entertainment. About 1 million fairgoers are expected to pass through the turnstiles at the State Fair over the 13 days.

The Oneonta Common Council approved plans to move forward with the redevelopment of the old Railyards at last night’s meeting.  Plans call for a variety of developments in the Roundhouse Road area, which are designed to bring more jobs to the region upon completion.

Delaware County continues to sell its recyclables at about the same rate as it has over the last several years, but they do have to be inventive in order to keep up with the market place, according to Delaware County Solid Waste Coordinator Tyson Robb explains:

Delaware County Sheriff’s Deputies arrested 28-Year-Old Ariel Alvarez of Walton, for Operating a Motor Vehicle with a Suspended Registration, Aggravated Unlicensed Operator,  Operating a Motor Vehicle without Insurance, Operating a Motor Vehicle without an Inspection Certificate, driving with an Obstructed view & Failure to Notify DMV of an Address Change, following a traffic stop recently.  Alvarez was issued appearance tickets for the Franklin Town Court at a later date.

SUNY Oneonta officials estimate that about 2000 new students are moving in today, as classes start for the fall semester on Monday.   A number of orientations for the new students will be held prior to the start of classes for the incoming freshman. 

Delaware County Sheriff’s Deputies arrested 23 year old Joseph Hahn of Walton for Driving While Ability Impaired due to Drugs, following an investigation of a 4 car motor vehicle accident on Main Street in Delhi.   Hahn allegedly rear ended a parked vehicle, causing damage to an additional two vehicles, while operating a motor vehicle while impaired by drugs.  Hahn was released on appearance tickets, and was scheduled to appear before the Town of Delhi Court at a later date for further process.

Chenango County Sheriff’s Deputies arrested 47 year old William Johnson for criminal possession of a controlled substance, for allegedly possessing Methamphetamines, crack cocaine & a narcotic during a traffic stop.  Johnson was arraigned in the Town of Plymouth Court & was remanded to the Chenango County Jail on cash bail pending additional court action in the Town of Plymouth Court.

Delaware County Sheriff’s Deputies arrested 31 year old Alycia Possemato of Guilford for Attempted Assault & Criminal Obstruction of Breathing or Blood Circulation, following a domestic dispute at the Delaware County Fair. Possemato was arraigned and remanded to the Delaware County Correctional Facility on $1,000 cash bail pending action in Village of Walton Court on a later date.

The State Department of Labor today released preliminary local area unemployment rates for July 2019. The State wide rate was 4%, locally; Chenango & Otsego Counties had 4% unemployment, Delaware County 4.5%.
